        @itsLIRAN Perhaps there's a similar argument in the opposite direction--let's say BTC was a commodity at inception but what if it gets centralized enough (or miners collude enough, etc) to make it fail some *updated* howie test that gets hatched in DC next year & retroapplied?

      @itsLIRAN the CFTC/SEC jurisdiction line might be less cart than horse-- they may care less about conceptual purity or logic than about an enforcement jurisdictional division, and work backwards from it. i'm not convinced the howie test is timeless...
